By booking any service with Lens Factor Media you acknowledge that you have read, understood, and agree to the following Terms and Policies.
1. Terms of Service
These Terms and Policies apply to all services provided by Lens Factor Media unless otherwise agreed to in writing.
The photographer reserves the right to refuse, postpone, or discontinue services at any time due to unsafe working conditions, abusive or inappropriate behaviour, illegal activity, inaccessible properties, or circumstances beyond the photographer’s reasonable control.
Lens Factor Media reserves the right to change prices, packages, services, and policies without notice. The version in effect at the time of booking shall apply to that booking.
Lens Factor Media provides services as an independent contractor. Nothing in these Terms creates an employment, partnership, or agency relationship.
2. Cancellation & Rescheduling Policy
Appointments may be cancelled or rescheduled without penalty provided at least 6 hours’ notice is given before the scheduled appointment.
Cancellations or rescheduling requests made with less than 6 hours’ notice may be subject to a cancellation fee equal to 25% of the total booking price. Any remaining prepaid balance will be refunded to the original payment method.
If Lens Factor Media must cancel due to severe weather, illness, equipment failure, safety concerns, or other unforeseen circumstances, the appointment will be rescheduled at the earliest mutually available opportunity or a full refund will be issued.
Repeated last-minute cancellations or rescheduling requests may result in future bookings being declined.
3. Payment Policy
Full payment must be received before photography begins unless otherwise agreed to in writing.
If payment has not been received before the scheduled appointment, Lens Factor Media reserves the right to delay, reschedule, or cancel the appointment until payment has been received.
All listed prices are exclusive of applicable taxes unless otherwise stated.
The Client is responsible for providing accurate property information, including the stated square footage. If the Client knowingly provides or represents an inaccurate square footage for the purpose of determining the applicable service fee, the Client agrees to pay the difference between the amount originally invoiced and the amount that would have been charged based on the property’s accurate square footage. This additional amount may be invoiced upon discovery of the discrepancy.
All service fees are charged on a per-unit/per-property basis. Each individual dwelling unit, suite, apartment or separately marketable property is considered a separate property for billing purposes, regardless of whether multiple units are located within the same building, share a common address, are stacked or attached, or are otherwise part of the same structure. Accordingly, multiple units or properties photographed during the same appointment will be billed separately based on the applicable rate for each unit or property.
4. Delivery & Turnaround
Final edited media is typically delivered within 48 hours following completion of the photography session.
Delivery times are estimates only and are not guaranteed. Turnaround may be extended due to high order volume, severe weather, technical issues, internet outages, equipment failure, illness, or other circumstances beyond the photographer’s reasonable control.
Every reasonable effort will be made to deliver completed work as quickly as possible.
Completed media will be delivered electronically unless otherwise agreed.
5. Copyright & Licensing
All photographs, floor plans, virtual tours, videos, and other media created by Lens Factor Media remain the exclusive intellectual property and copyright of the photographer under the Copyright Act (Canada).
Payment does not transfer copyright or ownership.
Any refund issued does not transfer copyright ownership unless expressly agreed in writing.
Upon full payment, the client receives a non-exclusive, non-transferable, limited license to use the delivered media solely for marketing the specific property photographed.
Unless prior written permission is obtained, the client may not:
- Sell, sublicense, or transfer the media to another individual or business.
- Use the media to market a different property.
- Provide the media to builders, contractors, designers, stagers, developers, Airbnb operators, property managers, or any other third party for their own commercial use.
- Remove watermarks or copyright notices, where present.
- Significantly alter, manipulate, remove existing edits, create derivative works, or use generative AI to substantially modify the delivered media. Minor resizing, cropping, compression, or automated enhancements performed by MLS platforms, brokerages, or social media services are permitted provided the overall appearance and integrity of the media are not materially changed.
The photographer retains the unrestricted right to use all created media for portfolios, website galleries, social media, advertising, competitions, educational purposes, promotional materials, and any other lawful business purpose unless otherwise agreed to in writing.
6. Hosted Media
Certain deliverables, including but not limited to virtual tours, interactive media, floor plans, or other hosted content, may be provided through third-party hosting platforms.
Unless otherwise agreed to in writing, hosted media is intended solely for the active marketing of the photographed property. Once the property is sold, leased, withdrawn from the market, or the listing agreement otherwise ends, Lens Factor Media reserves the right to remove, deactivate, or permanently delete any hosted media and its associated links without prior notice.
Clients who require continued hosting beyond the active marketing period must make arrangements with Lens Factor Media before the listing concludes. Continued hosting may be subject to additional fees and availability.
Lens Factor Media is not responsible for interruptions, outages, policy changes, or the discontinuation of services provided by third-party hosting platforms.
7. RAW Image Files
RAW (unprocessed) image files remain the exclusive property of Lens Factor Media and are not included with any photography package.
Only the edited, final media will be delivered. RAW files will not be released, sold, or provided to clients under any circumstances unless expressly agreed to in writing prior to the photography session.
8. Digital Enhancements
Services such as sky replacement, ground replacement, object removal, virtual staging, virtual twilight conversions, or other digital enhancements are provided for marketing purposes.
The client is solely responsible for ensuring that any edited media complies with the rules, regulations, and disclosure requirements of their brokerage, local real estate board, MLS®, or any other governing organization.
Lens Factor Media is not responsible for listing removals, fines, penalties, disputes, or other consequences arising from the client’s use of digitally enhanced media.
9. Editing Revisions
Standard editing is included with every package and is performed at the photographer’s professional discretion.
Reasonable revision requests may be accommodated where appropriate; however, additional edits beyond the photographer’s standard workflow may incur additional fees or be declined.
Requests for revisions must be submitted within 7 days of delivery
Extensive retouching, object removal beyond what is included, or repeated revision requests are not included unless otherwise agreed upon.
10. Privacy Policy
Lens Factor Media collects personal information including your name, email address, phone number, property address, and booking details solely for the purpose of providing photography services.
By booking services, the client consents to the collection, use, and disclosure of personal information as described in this Privacy Policy
Payments are processed through Stripe. Lens Factor Media does not store or have access to your complete payment information. Refer to Stripe’s Policies for more details.
Personal information is used to:
- Process bookings and payments.
- Communicate regarding appointments.
- Deliver completed media.
- Maintain business records.
- Meet legal, accounting, and tax obligations.
Personal information will never be sold by Lens Factor Media. Information may only be disclosed where required by law or where necessary to complete the services requested.
Reasonable safeguards are used to protect your information; however, no electronic storage or transmission method can be guaranteed to be completely secure.
10(a). Third-Party Services & Information Retention
Lens Factor Media uses third-party services, including but not limited to Hostinger, WordPress, Forminator, and Stripe, to operate its website, process bookings and payments, and provide services. These providers may independently collect, process, and retain information such as names, email addresses, phone numbers, IP addresses, appointment details, property information, payment information, and device or browser data.
Information retained by third-party providers is subject to their respective privacy policies, terms of service, retention practices, and legal obligations. Lens Factor Media does not control or guarantee the retention or handling of information by these providers. Clients are encouraged to review the applicable third-party privacy policies and terms of service.
11. Website Terms of Use
All content appearing on this website, including photographs, graphics, logos, branding, text, pricing, and design elements, is the property of Lens Factor Media unless otherwise stated.
No content may be copied, reproduced, modified, distributed, published, or repurposed without prior written permission.
Information on this website is provided on an “as-is” basis. While reasonable efforts are made to maintain accuracy, Lens Factor Media makes no guarantee regarding the completeness, accuracy, availability, or uninterrupted operation of this website.
Use of this website constitutes acceptance of these Terms and Policies.
12. Refund Policy
Due to the nature of digital photography services, all sales are final once completed media has been delivered.
Refunds will not be issued because of personal preference regarding editing style, composition, lighting, weather conditions, staging, digital enhancements, or market performance.
Where a cancellation refund is applicable, any cancellation fee outlined in the Cancellation & Rescheduling Policy will first be deducted.
If Lens Factor Media is unable to provide the contracted services due solely to circumstances within the photographer’s control, a full or partial refund may be issued at the photographer’s discretion.
13. Property Readiness
Clients are responsible for ensuring that the property is reasonably prepared prior to the scheduled appointment.
Minor adjustments during the session may be accommodated where practical; however, extensive cleaning, decluttering, landscaping, staging, or moving furniture may increase photography time, require additional charges, or require the appointment to be rescheduled.
The photographer is not responsible for cleaning, staging, organizing, repairing, or preparing the property.
If the property is not reasonably ready upon arrival, Lens Factor Media reserves the right to photograph the property as presented, reschedule the appointment, shorten the session, or apply additional charges where appropriate.
The client is responsible for ensuring that the photographer has safe and lawful access to the property. Dangerous animals should be secured before the appointment. The photographer may refuse to enter or discontinue services where conditions are considered unsafe.
14. Image Retention
Lens Factor Media will make reasonable efforts to retain completed media for at least three (3) months after delivery.
While reasonable efforts are made to maintain archived files beyond this period, long-term storage is not guaranteed. Clients are strongly encouraged to download and securely back up all delivered files immediately after delivery.
15. Limitation of Liability
The photographer shall not be liable for delays or failure to perform services resulting from severe weather, natural disasters, power outages, internet outages, equipment failure, illness, traffic conditions, property access restrictions, acts of third parties, or any circumstance beyond the photographer’s reasonable control.
The photographer is not responsible for inaccessible rooms, unfinished construction, inaccurate listing information supplied by the client, property defects, or changes made to the property after photography.
To the fullest extent permitted by applicable law, the photographer’s total liability for any claim arising from the services provided shall not exceed the total amount paid by the client for the affected booking.
Under no circumstances shall Lens Factor Media be liable for indirect, incidental, consequential, punitive, or special damages, including but not limited to lost profits, lost commissions, missed sales opportunities, business interruption, reputational harm, or similar losses.
16. Governing Law
These Terms and Policies shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the applicable laws of Canada.
Any dispute arising from services provided by Lens Factor Media shall be subject to the exclusive jurisdiction of the courts of Ontario.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
These Terms constitute the entire agreement between the parties regarding the services provided and supersede any prior discussions or understandings unless otherwise agreed to in writing.
